Defence prepares for trial in case of fatal Newmarket stabbing

A lawyer for a Toronto woman accused of second-degree murder in the death of a Newmarket man has requested more time to retrieve notes from the Crown before finalizing trial plans.

Criminal defence lawyer Sherif Foda appeared in a Newmarket Ontario Court of Justice meeting via video on behalf of McKenzie Gill, 30, on Oct. 8 at 9 a.m. His client is facing a charge of second-degree murder in the stabbing death of Blake Bibby, 36, in July.

“There’s really just one general category of disclosure that is outstanding that may impact on how the defence decides to proceed,” said Foda.

Foda received previous correspondence from Crown attorney Brian McCallion on Sept. 12. He, however, is seeking more time to retrieve and review specific investigative files to determine how to present the case.

Details of the court matters cannot be released as a publication ban has been placed on all submissions and evidence presented in the courtroom.

Justice of the Peace Ann Johnson scheduled a new court date for Nov. 6 in courtroom 106 at 9 a.m.

York Regional Police were called to a building on Millard at about 10:30 p.m. July 14 for a report of an injured person. Bibby was transported to hospital, where he was pronounced dead.
