Officers cleared of wrongdoing in King City arrest after man says sternum fractured

An altercation with police took place in a restaurant last October, SIU reports

Ontario's Special Investigations Unit (SIU) has found no criminal offences were committed by two York Regional Police officers during an arrest in King City last fall that reportedly resulted in the suspect fracturing his sternum. 

The incident took place on Oct. 8, 2020 at a King City restaurant when a 42-year-old male was arrested for causing a disturbance, put on the ground, handcuffed, charged and later released to his family, according to an SIU report released today. 

Last November the man filed a complaint with York Regional Police's Newmarket district, stating that his sternum was fractured during the arrest, prompting an investigation by the SIU. 

SIU director Joseph Martino found that neither of the two officers involved used unnecessary force or acted unlawfully. 

Evidence from the investigation, including footage taken inside the police cruiser, did not show any indication of pain from the complainant, according to the SIU. At one point, the man was seen moving his handcuffed hands from behind his back, under his legs and out in front of him. 

During the video, the man was also heard saying that officers broke his ribs and his sternum. 

The SIU report confirms that while the injury may have been sustained during his altercation with police, there is no evidence that the officers did anything wrong and the case has been closed.
