The developer behind an Aurora subdivision proposal on Old Bloomington Road is taking the town to the Ontario Land Tribunal.
TWTH Development Inc. has filed the appeal, titled “OPA- Failure to make a decision,” regarding its proposal for 30 single-detached lots at 252 to 272 Old Bloomington Rd., which lies near the intersection of Bloomington and Yonge Street.
The planned subdivision development would see 30 lots on the 3.89 hectare plot, with the developer seeking a higher density than current zoning allows. The current “estate residential” zoning limits the density to five units per hectare, with the developer seeking 7.72 units per hectare.
The developer initially brought the proposal to a public planning meeting in November 2023, with council asking for a report to be brought back to a future public planning meeting to address concerns about density and road access.
The new plan, presented at a second public planning meeting on Oct. 8 last year, saw the developer cut the number of lots from 33 to 30 and changed the plan for the road access. The new road access would be "more direct," according to Adam Layton, associate principal at the Goldberg Group, a North York-based urban planner who presented the proposal at the Oct. 8 meeting. Layton said the changed road also addressed concerns about encroachment on environmental features on neighbouring properties.
Despite the changes, Aurora resident Warren McClure, on behalf of the Ratepayers of Yonge Street South, spoke against the development during the meeting. He said he was concerned about the density.
Council ultimately asked the town's planning and development services to bring a report to a future committee of the whole meeting that addressed the concerns brought up in the meeting.
The case is at the intake stage with the OLT, with a hearing date not yet set.
