Ontario tribunal hearing set for Aurora medical marijuana plant

A merit hearing will be held by the Ontario Land Tribunal on Feb. 11 following a justice of the peace decision barring the plant from operating at 95 Dunning

In 2022, the Town of Aurora’s building division laid charges against the building owner of 95 Dunning Ave. and the tenant for operating a marijuana facility, breaking the building’s zoning bylaws.

A hearing date has been set in the Ontario Land Tribunal case regarding a bylaw-breaking medical marijuana plant at 95 Dunning Ave. in Aurora.

Last October, the town’s committee of adjustment rejected a variance application from the property owner, 2209640 Ontario Ltd., to allow the facility to remain in place.

The property owner then directed Jim Kotsopoulos, who represents tenants of the property, to submit an appeal to the town's decision to the tribunal.

Now, a merit hearing is set to be held Feb. 11.

The hearing comes after the property owners were convicted of breaking the town’s bylaws in Ontario court, with Justice of the Peace Linda DeBartolo issuing a two-year probation order. 

The order bars 2209640 Ontario Ltd. from using 95 Dunning for a medical marijuana production facility, and is effective until Nov. 14, 2026.

The town initially charged the owner and tenant with illegally operating the business against the town’s zoning bylaws and official plan in October 2022.

The facility had been running for more than four years, with the town first receiving complaints about the operation in July 2020, according to a town staff report.

The site has drawn the ire of several local residents over the years.
