Judge seeks pre-trial date for case against Aurora cannabis facility

Owner's paralegal opposed pushing ahead with a trial date, saying the tenant will submit paperwork that would allow the business to remain

The matter was discussed in Provincial Offences Court in Newmarket on Thursday, July 18.

The case involving a bylaw-breaking cannabis facility at 95 Dunning Ave. is headed for a judicial pre-trial.

In 2022, the town charged the owner and tenant of 95 Dunning for operating a cannabis facility in the building against zoning bylaws, in the mostly residential downtown neighbourhood, according to Doug Nadorozny, chief administrative officer for the Town of Aurora.

But the business is still in operation, much to the frustration of the town and area residents.

At an appearance on July 18 in Provincial Offences Court in Newmarket, the judge sought to set a date in August or early September for a judicial pre-trial hearing.

Speaking during the appearance, Peter Swales, principal paralegal for SW Legal Services PC, who is representing the owner of 95 Dunning, said he was opposed to pushing ahead with a trial date, as the tenant in 95 Dunning is seeking to submit paperwork that would allow the business to remain in place.

He said he anticipates that the application for a variance would be ready to brought before the Town of Aurora’s committee of adjustment in September.

The matter was referred to the trial co-ordinator, who will set a date for a judicial pre-trial in August or September.
