Sentencing postponed for Newmarket man guilty of manslaughter

Alexander Jolly of Newmarket is awaiting sentencing after pleading guilty to manslaughter in the death of 22-year-old Nicole Mercer.

The Newmarket man who pleaded guilty to manslaughter in a 2022 fatal shooting has had his sentencing postponed.

Alexander Jolly was scheduled to appear in Newmarket court Nov. 4 to be sentenced, after making the plea last month. Jolly is said to have fired a gun at 22-year-old Nicole Mercer, who was pronounced deceased at the hospital following the July 29 incident.

The postponement is until Nov. 29, due to jailers not making Jolly available for a scheduled appearance and other cases having to get underway.

Representation for Jolly also said that the man had an injury to his knee while in custody recently and requested medical treatment, which may have necessitated an adjournment if Jolly would be in too much pain to focus.

According to an agreed statement of facts, Jolly and his friends were in his room when Mercer left because of the noise. When she returned and knocked on the door, Jolly pointed the gun and fired. Mercer was the mother of a five-year-old at the time.

Jolly was originally arrested Sept. 9, 2022, and initially charged with second-degree murder and several firearm offences.
